IMS Files Lawsuit Against HUK-COBURG Group

The globally-leading telematics solutions provider IMS (Insurance and Mobility Solutions), through its IP-holding subsidiary Appy Risk Technologies Ltd, United Kingdom, has recently filed a lawsuit against several companies of the HUK-COBURG Group (Germany’s largest motor insurer) at the Regional Court Düsseldorf about their telematics insurance product “Telematik Plus”, provided by Cambridge Mobile Telematics.

The IMS group is the owner of a patent which concerns smartphone-based telematics technology, a recent innovation that is increasingly critical to the auto insurance industry. Using this telematics technology and the usage data it provides, car insurers can offer their customers rates that are adapted to the individual driving style and habits of the respective policyholder.

IMS offers to market a suite of hardware and software-based telematics solutions, many of which are underpinned by a portfolio of over 120 international patents related to road safety, connected car and mobile applications. As demand for Usage-Based Insurance (UBI) in both personal lines and commercial lines continues to surge globally, accelerated by the reducing cost of connected vehicle data and increased consumer acceptance of UBI, the company is seeking to protect its investment in developing these new technologies by enforcing several patents that they believe are infringed by third parties.

With its “Telematik Plus” insurance tariff, the HUK-COBURG Group uses telematics technology. IMS had explained its allegation in detail to the HUK-COBURG Group. IMS attempted to avoid legal proceedings, however, with its action before the Regional Court Düsseldorf, IMS is now demanding, among other things, an injunction and a declaration that the defendants are obliged to pay damages.

IMS is determined to enforce its IP rights. The company is being represented in a lead role by attorney Dr Christof Augenstein, a renowned expert in patent litigation and name partner of the Düsseldorf-based law firm Kather Augenstein Rechtsanwälte, which specialises in industrial property rights.
