FCA Update on Motor Finance Redress Creates Uncertainty, Says Aurora

The decision to compensate those who took out loans or lease plans on cars in the past has provoked a flurry of TV ads and online marketing from Claims companies. But the process itself may prove complex and take years. In the meantime those looking to finance vehicles today – or brands offering insurance as part of a vehicle lease plan – need clarity on the issue of fairness as regards those contracts and interest rates. No use coming back in 15 years and then stating the terms were unfair, the FCA needs to decide on today’s agreements – are they fair and reasonable, or not?

Here are some thoughts from Aurora;

Following today’s update from the Financial Conduct Authority outlining key considerations for a potential consumer redress scheme in the motor finance commission scandal, George Holmes, business finance expert and Managing Director of Aurora Capital, says:

“The FCA’s statement offers some reassurance that a redress scheme won’t be rushed, but for small lenders and brokers, the uncertainty is already starting to hit. While the regulator rightly wants to balance fairness with proportionality, smaller firms still face months of limbo, with major operational and financial consequences.

The biggest risk now is paralysis. With the FCA confirming that a decision on a redress scheme won’t come until late September, smaller finance providers may freeze lending activity or pull back from the market entirely. That’s a serious issue for small businesses that rely on these providers for asset and vehicle finance to keep moving.

The FCA says it’s mindful of unintended consequences, and that’s welcome. But any redress scheme must avoid blanket liabilities that punish firms that acted within the rules at the time.

The longer this drags on, the more pressure small lenders will face. Clarity, fairness, and speed are now critical. If we want to preserve competition and protect small businesses, the FCA must deliver a response that is both targeted and measured.”
