Credit hire can be expensive, so this new pilot scheme looks interesting. This latest new product has been piloted by a trio of companies, here’s the word;
Nuvalaw has announced the successful launch of the UK’s first live credit hire arbitration pilot with esure and Winn, bringing together a leading insurer and a major accident management and legal services provider to test a faster, simpler and more cost-effective route for resolving disputed claims.
The pilot is designed to move suitable disputed credit hire cases away from adversarial litigation and into a binding, independent arbitration process delivered through the Nuvalaw platform.
It comes against the backdrop of the post-Churchill landscape, in which alternative dispute resolution is no longer a peripheral option but is now expected by the Courts to be the first step where a faster, fairer and more proportionate outcome can be achieved.
The first batch of live claims has already been processed successfully, with both parties providing feedback that has helped refine the platform and protocol ahead of the next phase of the pilot.

Alternative dispute resolution can drastically shorten claim lifecycles and lower the legal costs associated with litigated disputes, with Nuvalaw’s data potentially showing savings in the region of 50% across litigated credit hire disputes.
At scale, the approach is expected to deliver significant savings across the system, including through faster case resolution, lower legal spend, and improved reserving efficiency for insurers.
Over time, Nuvalaw also expects the model to generate a valuable body of data that can help signed up users across the market make better-informed reserving and settlement decisions.

Adam Thorpe of Winn Solicitors said: “By voluntarily moving disputed cases out of the court system and into independent arbitration, the parties are demonstrating a practical way of easing the pressure on the courts and supporting the Ministry of Justice’s wider objectives around alternative dispute resolution.

Nuvalaw expects the pilot to continue with further batches of live claims, with the intention of rolling the model out more broadly following successful completion.
